Facing life in prison on a molestation charge, a 46-year-old East Naples man accepted a plea bargain Tuesday for a 6 1/2-year prison term while still proclaiming his innocence.
“Somebody used me,” Alberto Estrada said as he pleaded no contest Tuesday to attempted sexual battery, a first-degree felony.
Estrada, who had denied molesting an 8-year-old girl, was adjudicated guilty by Collier Circuit Judge Frank Baker, who gave him credit for time served in the county jail since his arrest on Jan. 17, 2007.
Baker also sentenced him to five years of sex-offender probation after his release, which will require Estrada to wear an ankle monitor, prohibits him from going near schools, bus stops, parks and other places children congregate, and requires him to register his address for a state database of sex offenders.
Baker also deemed him a sexual predator. Baker told Estrada, a carpet installer who was here legally, that he may never serve probation because he faces deportation due to the conviction.
Estrada faced up to life in prison on the original capital charge, sexual battery of a child less than 12, and up to 30 years for the first-degree charge, lewd lascivious molestation. He pleaded to a lesser and included charge under the capital offense.
The plea agreement, which also dropped the second charge, was negotiated by defense attorney Landon Miller and Assistant State Attorney Deborah Schwartz.
Neither the girl nor her mother came to sentencing and Schwartz said she’d been unable to reach them. Miller declined comment after sentencing.
Estrada was arrested on Jan. 17, 2007, four days after the girl’s mother contacted the Collier County Sheriff’s Office to report that he’d inappropriately touched her daughter while she was visiting his home earlier that month.
The arrest report says the 8-year-old told investigators with the Sheriff’s Office and the Child Advocacy Center of Collier County that on Jan 8, 2007, Estrada told her that she could stay home from school and spend time with him. Her 4-year-old brother also stayed home, she said, but her older brother was at school.
Arrests reports say the girl alleged that Estrada had molested her several times before, including on her birthday, and that the incidents always occurred at his house.
She said she was scared to tell anyone because Estrada threatened to spank her, the arrest report says.
Investigators located Estrada at his East Naples home and arrested him.

WoW! Who said the wheels of justice grind slowly? Just a few hours ago I read this guy was arrested at Target. Good work CCSO and Judge Baker!

A plea deal for a capital crime....ending in a 6 1/2 year prison term? Did I read that right?
Why can he plea out to charges like this? This schmuck will get out in 5 years and strike again. This makes me sick that this guy will see freedom again.

Good deal for the criminal....1. Up to life for one charge and up to 30 for the second charge - or - 6.5 years with part of that already served. He'll be out in 5 years.... all that other stuff, i.e. registered as sex offender, ankle bracelet is garbage. It doesn't work.... Our justice system is awful....

Maybe he's guilty, but I wonder. Child's mom lost custody to him, then turned around and alleged abuse. She now has the kids. Hmmm.
