Sheriff candidate files ethics complaint against Rambosk

For the second time in three months, a candidate for Collier County sheriff filed a complaint with a state commission accusing fellow candidate Kevin Rambosk of violating state statutes.

Collier County businessman Vinny Angiolillo, the owner of Class Act Limousine in North Naples, filed a complaint this week, this time with the Florida Elections Commission.

In the complaint, Angiolillo, who once compared the Sheriff’s Office to a criminal gang, alleges that both Rambosk and the Sheriff’s Office “wantonly disrupted” his political campaign and caused “irreversible damage” to his campaign and reputation.

Sheriff Don Hunter called the complaint “enormously misleading.” Rambosk, an executive officer with the Sheriff’s Office, called it “politically motivated, irresponsible and malicious.”

Angiolillo said he mailed the complaint on Thursday and confirmed its receipt on Friday. However, Kevin Smith, an investigator with the commission, said he could neither confirm nor deny receipt of the document due to commission policies.

In the complaint, Angiolillo makes four charges against Rambosk and the Sheriff’s Office, two of which have to do with Angiolillo’s October 2007 arrest on misdemeanor counts of violating an injunction against repeat or dating violence. In June, the charges against Angiolillo were dismissed in Collier County court.

“I was arrested illegally using illegally obtained information,” Angiolillo said.

Angiolillo said a recording that was made of him by the woman who had the injunction against him was done without his consent. He also argues that if the Sheriff’s Office had investigated the allegations against him, his name would have been cleared.

“It was all used as a wedge politically to keep me out of the campaign,” Angiolillo said.

Angiolillo was arrested one week after announcing his candidacy. He argues that Rambosk, who was serving as undersheriff at the time, had a duty to review his case before taking action.

Hunter said Angiolillo’s complaint “doesn’t fit with our understanding of the facts.”

“The capias warrant was issued by the State Attorney’s Office, served by the Collier County Sheriff’s Office and at first appearance, a judge certified a finding of probable cause,” Hunter said in a statement.

Angiolillo contends that he should have been issued a summons instead of being arrested.

“The current administration and all of the politicians took me very seriously from the beginning and knew that I was their only serious threat,” Angiolillo said.

In his third charge, Angiolillo argues that on May 24, deputies disrupted a town meeting he was holding at VFW Post 7721 off of Pine Ridge Road. He said that deputies were parked at the entrance to the VFW with flashing lights denying access to the building.

Hunter said the incident actually occurred on May 17, more than two weeks after Rambosk was reassigned from his role as undersheriff with supervisory duties. Rambosk was reassigned to avoid running afoul of the Hatch Act, a federal law designed to prevent government employees from using their positions for partisan gain.

An incident report from May 17 indicates that the Sheriff’s Office received a complaint that a white pickup bearing Angiolillo’s campaign signs was parked diagonally in the grass median on Pine Ridge Road and was obstructing the view of motorists.

When Angiolillo and two others arrived to move the truck, they arrived in “a very arrogant and pushy manner,” the report said.

Finally, Angiolillo argues that the Sheriff’s Office, under Rambosk’s supervision, has removed his towing company, AA Auto, from its rotation. Angiolillo is a minority owner of the company.

In a statement, Hunter said there have been some policy violations with AA Auto, but that the Sheriff’s Office has been in contact with the company’s owner, Tom Sepanski, about corrective actions and getting the company back on the rotation list.

Hunter said that neither he, Rambosk, nor other members of his command staff were aware of Angiolillo’s interest in AA Auto.

“My opponent knows that this complaint is politically motivated, irresponsible and malicious,” Rambosk said in a statement. “He has deliberately created a false complaint because he knows that I have not been the undersheriff with supervisory authority since May 2, 2008.”

Smith, the investigator with the elections commission, said complaints are turned over to an investigator and then make their way to members of the commission to rule on. There is no time frame for complaints to be investigated, he said.

This is the second complaint filed against Rambosk by another candidate for Collier sheriff so far this year.

In February, Victor Ortino, a private investigator running for sheriff, filed a complaint against Rambosk with the Florida Commission on Ethics alleging that Rambosk was campaigning while on duty and using his official position to intimidate subordinates. The ethics commission dismissed the complaint less than two months later.

Overview

Undersheriff Kevin Rambosk, being in control of the Collier County Sheriff’s Office, during the course of his duties knew or should have known that I, Vincent D. Angiolillo, was being arrested by his agency. This action had a negative effect on my campaign, for the same office sought by him.

The crime that I allegedly committed occurred on May 12 & May 26, 2007. The Collier County Sheriff’s Office investigated two separate violations of an order for protection. One charge was based on an illegally obtained wire taping of a phone communication, in violation of Florida Statutes section 934.03 & 934.06. The second was based on false statements given by the best friends of the woman who obtained the order.

During the course of the investigation the Collier County Sheriff’s Office never contacted me to contest the violation or obtain witnesses to dispute the charges.

The investigation was held up for 5 months until the day I filed as a Candidate for Sheriff of Collier County. A capias was issued on October 12, 2007 by the Assistant States Attorney yet no judge ever signed a warrant for my arrest. With my neighbors watching, I was physically arrested, with no warrant, from my residence, for a misdemeanor in lieu of issuing a summons as required by State Statute 901.09. A physical arrest was made in order to disrupt and discredit my campaign and impugn my character. The case was extended and continued for 8 months violating the rules of evidence and discovery with no further investigation.

On June 11, 2008, the charges were dismissed by the court.

Simple investigative procedures were not followed by the Collier County Sheriff’s Office investigators which would have easily prevented my arrest.

A. Facts of charges/count #1

Violation of an Injunction order - NO CONTACT –(see attachment #1)

(a.) Crystal the person with the order of protection against me acknowledges

and deputy Hurley confirms, that she initiated the contact by her call.

(b.) Crystal acknowledges no one answered the phone.

(c.) Although I did not answer the phone, Crystal tape recorded a

background conversation allegedly between myself and a client,

who was present when she called my number 239-450-0427.

(d.) This being a two-party state Fl. Statute 934.03 and 934.06 the interception of the conversation was obtained illegally without my consent and used as the sole evidence and foundation for count #1 of the charge against me.

(e.) The illegally obtained recording was then passed to the Collier County

Sheriff’s investigator and the States Attorney in violation of Federal Law.

This violation is currently being under investigation by the F.B.I.

Knowing I did not initiate the call, and the communication was illegally obtained, the Collier County Sheriff’s Office still persued and effected my arrest.

(B.) Facts of Charge/Count#2

Violation of a restraining order - Prohibited from with 500' business.

(a.) The sole witnesses for the state were Crystals’ best friends.

She was financially indebted to and the licensed Realtor for the sale

of their residence.

(b.) Statements from the sole witnesses were misdated, conflicting and never sworn.

(c.) Re-enactment, (simply going to the scene) would have revealed that the conflicting statements were false.

(d.) At no time was I contacted regarding my whereabouts, if so the Collier County Sheriff’s office would have learned:

(1.) I was in a limousine not a sedan as described by witnesses (all day)

(2.) At the time of the alleged incident I was with several clients in the limousine.

(3.) I was never at the location in question.

A follow up on the witnesses statements and the most perfunctory investigation of the allegations would have easily cleared my name.

The pursuit of the alleged violation was a gross dereliction of duty by the Collier County Sheriff’s Office.

(C.) Count #3

Under supervision of Kevin Rambosk, the Collier County Sheriff’s Office did

disrupted a political campaign town meeting. Access to the location was blocked.

(1.) On May 24, 2008 During a political campaign function paid for by my campaign, a town meeting was held at the VFW on Pine Ridge Road.

This function was advertized prior to the event.

Sheriffs’s deputies (3 vehicles) were parked in the left turn lane entering the VFW. Patrol cars were stopped with lights flashing for 2 hours denying access to the entrance of the campaign function.

This was witnessed by several patrons and voters of the community.

(see witness list attachment#3).

(2.) VFW owners/operators stated that they routinely serve 30 customers diner on a typical Saturday. They served none that evening due to the actions of Collier County Sheriffs’ officers.

(D.) Count #4

Under supervision of Kevin Rambosk, the Collier County Sheriff’s Office has removed my towing company from the Collier County Sheriff’s rotation list. This was done in violation of Collier County Sheriff - wrecker rules

1.26.15 and 1.26.16( see attachment #2). We have attempted to appeal this as outlined by the Collier County Sheriff’s towing rules and have received no response, for 40 days.

Because I was a high profile arrest, a candidate for Sheriff, Kevin Rambosk, the Undersheriff, being my opponent and in charge of operations, should have reviewed all the above cases prior to any action being taken.

His failure to do so implicates his neglect and willingness to allow the unsubstantiated charges and violations to proceed.

As a result Kevin Rambosk has willfully and wantonly disrupted my political campaign.

His actions or in-actions have done irreversible damage to my campaign and my reputation in the community.

As least we have options for candidates this year. Unlike previous years where Heir Hunter went uncontested, always good to have options.

He's a politician all the way avoid the questions. I have no doubt he is violating election laws. It's no secret they use sheriff's office equipment while on duty. I would bet he's accepted checks while on duty from other deputies. You know if you want to keep your job & you are Lt. & above you are expected to donate & where his t shirt & bumper sticker even if you aren't going to vote for him. Also I know for a fact at one point thier was Rambosk campaign literature in District 1 substation till someone complained then it was removed. Yeah, let’s vote in Vic or Vinnie so the taxpayers can send them to the Basic Law Enforcement Academy so they can become a “real cop”. And, when (and if) they graduate, they can attempt to run a multi-faceted, 1400+ member agency, (that neither knows nothing about) although neither has supervised more than 5 people before. Yeah, that’s smart. Plus, the overwhelming numbers employed at the S.O. support Rambosk (Go to a debate & see). Let's have some time card problems. Let's re-hire the deputies that were fired for illegal, immoral, and unethical behavior, and make them supervisors for the other rank & file. Let's not actually have a sheriff for 6 months while Vic gets trained to be one. I guess Rambosk will continue to run a tight ship until he is ready. If this doesn't make sense to you, VOTE RAMBOSK. If you truly want to vote for Vic, please help find a bunch of deputies to replace the ones that resign and leave if he is elected. Vinny is a joke, he said his son parked the truck on the median. We here in Collier have the lowest crime rate (except civil rights violations) and therefore should not complain! Our Sheriff and deputies are willing to do what it takes to get the job done (Civil rights aside) and we all need this type of protection. If we did not have them who would protect the county if Obama gets elected? The choice is clear Law and order(Except Civil Rights) with the status quo or change forward. Its clear where the Deputies stand and I say stand with them or ...

Did Mr. Rambosk quit the department?
According to the Hatch Act, which is very clear, no employee, which Mr. Rambosk is nomatter what position he is move to, may run for political office. In other words his running for the office of Sherriff as an employee is in direct federal violation of the Hatch Act.
Look like a case of black letter law to me.
I believe Mr. Rambosk took an oath to uphold the law not violate it. His advisors didn't think thisone out very well.

Tops cops who are real cops now that's funny at the CCSO. Besides Rambosk is sending all his friends to the academy thinking he's going to get elected then they are coming in at top positions. Never been cops & they will be telling cops what to do. I bet there are plenty of guys who have done their time on the road & with hands on experience with 10+ years that could be top cops. Won't happen. How about Rambosk getting his buddy hired is as Building Maint. Manager at $120,000 a year (twice what Gary was paid when he retired) & he's going to the acadamy, why to be a top cop. Same corrupt agency. Rambosk knows what CF did & he's helping cover it up. He has a duty as a LEO to report crimes & he's not. He also has a duty to have the balls to stand up to Hunter & tell him favoritism is not right. He won't. Just wait things will get worse if he's elected. I've been to the debates & Rambosk lost. VOTE ORTINO. As for the deputies behind Rambosk don't be so sure. They don't have free speech & can't speak out. As for the ones that show up to debates & stuff they have to to keep their jobs. well, let's look at the facts: Vinnie's case was dropped on a technical issue. On the day of his trial, the state's attorney couldn't find a piece of paper and the Judge dropped the case. The charge may be re-filed and Vinnie could be re-arrested. Let's hope so!!! As far as Ortino, we have a fraud charge that got him fired from FHP, he hires the people fired from CCSO (and we all know how badly one has to screw up to get fired from there.) As far as I can see, the only Candidate with the training and background that qualifies for sheriff is Rambosk. You have my vote. And, thanks Kevin for keeping your campaign POSITIVE!

We can't afford another professional bureaucrat eating at the public troff. Rambosk is not a lifer LEO. He is a bureaucrat lifer. Put him in the real world, not on the public dole, and he would just be another pretty face scooping corn on the back 40.

There are dozens of mirror images to Rambosk in Collier County government that must be voted out. The public needs to take control of our government and get it out of the bureaucrat's hands. The only way to do this is to elect outsiders and elect strong fiscal conservatives to office.

This election is just one of many that must see a change if Collier County will ever return to the fiscal conservatism it had 30 years ago.

Ortino has this Naples resident's vote!

Hey corn, go to the Supervisor of Elections web-site. Look at Rambosk & Ortino’s total contributions and total spending. Ortino has spent nearly all of his campaign money, whereas Rambosk has spent under half of his. Even though Rambosk has more money in his campaign, Ortino has outspent him, and on what? I have only seen a handful of Ortino bumper stickers and 3 Ortino T-shirts to date. Comparatively, I see Rambosk bumper stickers all over town and tons of his T-shirts. Ortino’s spending does not support your argument of Ortino bringing back fiscal conservatism. Rambosk seems to be spending wisely. Just what experience does Ortino have running anything that has a budget of this size? None, and I sure don't want a non-experienced person blindly running the S.O. Rambosk has my vote!

Rambosk is qualified, good to work with, intelligent, and listens to what people have to say. I have absolutely no obligation to support anyone, but I definitely support Rambosk. He is capable and competent. I have met Ortino, and no way could I vote for him over Rambosk. The other two together don't add up to half Rambosk's qualifications. I hope the voting public isn't persuaded toward Ortino by the bitter and uninformed.

Vinny, I wish you all the best!! This is the worst police dept. ever!!! There may be a few good ccso left, but we need a new sheriff and not Rambosk, someone that knows nothing about this dept, and 90% + new deputy's. Then maybe this town will have a chance, until then forget it. But the public needs to be more vocal about all the wrong doing and things that arent fair and right in this town. When people get arrested for medical conditions that is WRONG! When police pull you over for reasons like not coming to a complete stop at a stop sign (yet he couldnt have known when there was a suv behind me) or wanting to search your car for no valid reason. WRONG!!! ACLU needs to be contacted by everyone that's been done wrong,contact lawyers, legislatures, tv ,newspapers, etc. We need a big change in this town and it's only going to happen when people start speaking up and refusing to take any more of this crap. You guys that brag on this community's safety slay me. Collier County is 75% 55 and over. Not 1/2 the minorities as other counties in FL. This county should be the safest with 1/2 the police force.

You overbearing egomaniac bureaucrats and coat tail supporters don't fool me. We need a change at every elected position in the county, including the Sheriff's Dept.

Vote out Rambosk and all incumbants. Vote for Ortino!

The more the other two go after Rambosk in this way, the happier I am that I will vote for Rambosk. Seems Vinnie and the other bozo are running the best campaign FOR Rambosk that they possibly could.

None of my family would consider voting for the other two.

Gulf, first, Rambosk has not yet been voted in, so we can't vote him out. (You can try in 4 years from now though) It sounds like you want Vic so the County can be compared to the others you describe. And finally, where do you get your stats? What you wrote is only your impression, which is far from reality. You need to get out more. Besides, you'll be safe out there! With Rambosk running the S.O. we will all continue to enjoy a safe County.

I'm very proud to say you're my neighbor in this great county of ours, and I want to thank you for your commitment to the people of Naples, and finally to all of Collier County. Many are called but seldom do some "step up" and serve.

To your family I offer my encouragement that the negative comments blogged in this forum, as well as others past are posted by seldom proud and certainly uncourageous, spiteful people who the majority of us, in our great Collier County-Naples-Marco Island, could certainly do without.

Kev, I'm sorry this is not our old Ridgewood/Midland Park anymore, but with your MOST CERTAIN ELECTION VICTORY in November, and the MANY FUTURE TERMS that you will continue to serve your Collier neighbors I know in my HEART that you will make our world a little better, certainly a lot safer, and that your proud deputies will surely remain Collier County's Finest. I wouldn't waste my valuable time reading every word of the posts above, but this entire election has highlighted just how ignorant some people really are, and that makes our great election process a very dangerous thing.

For ANYONE to think this Vinny fool is qualified to be a deputy, let alone Sheriff, is ridiculous. You are either too blasted dumb for your own good, or are one of those "change for the sake of change" types, or maybe have not lived here for the past 35 years and understand how great it is to have little to no crime, to have the comfort of knowing anyone that screws around with our Sheriff department is going to end up on the short end of the deal.

Vinny: you are done. Give it up. It was over before you ever started.

Kevin: Let me apologize for the rest of the good people in Collier county for the jerks that gravitate to fools like Vinny. They can't help themselves and I know you will still be there to protect their dumb butts when thye need help.

Vinnie wants to be Sheriff, but he does not even know the law relating to his own arrest. Their are several circumstances under which you certainly can record a person's telephone conversation without their consent.

Anyone who has seen vinnie in a Sheriff's debate knows that he is a joke. One of his promises is to give ALL county employees a 6% pay increase. Not only can we not afford this, but the Sheriff does not have the authority to give anyone but deputies raises.

Ortino is a joke. He worked for FHP for 1.5 years before being fired for intentionally incorrectly recording his time on his time card(fraud). Then he became a private investigator and spent a life snooping on cheating spouses. He also helped someone sue the Sheriff's Office. Now, he wants to be Sheriff and he and his ally(vinnie) continuously file false complaints against the only honorable man in the election, Rambosk.

Vote Kevin Ramosk for Sheriff.

It seems only time will tell who will win, we all have our doubts, concerns and issues with each candidate obviously. Onlt time will tell who becomes Sheriff on August 26th, 2008.

Why does he break the law then? Deliberately parks a vehicle in the median/right of way of a busy roadway. Several vehicles actually almost hit the truck and signs.

Two things I am NOT looking for in a candidate for Sheriff is; #1. one hwo has a prior arrest record and #2. one who has been fired from a prior law enforcement job.

Oh and by the way Vinny if you are looking for a little R&R from the race I know a nice little "bed and breakfast" for you. It is located about a mile or two east of the interstate on Golden Gate Pkwy.

Pack a light bag the minimum stay is 72 hours.

Oh and for the previous post about the Hatch act of 1939 (not to be confused with the same named act of 1887). All federal employees are prohibited from running for office in a partisian race. Local government employees are prohibited from running in partisian races IF (and only IF) their salaries are paid by the Federal Government in one form or another (i.e. grants and special programs). Exeutive Officer Rambosk was moved not because his salary was paid in such away but to remove him from supervisory duties of those who's salaries are paid by federals funds. Just in case the other two canidon'ts wanted to raise an issue.

So to clarify, Deputy Joe Blow of the traffic divisions DUI Task Force who's salary is paid by federal funds can not run for Sheriff while holding his position. The Under Sheriff, whose position is a budgeted position paid for by the county can.

"Michael Hunt", you are obviously a "disgruntled" employee and bad at stretching the truth. The information about Ortino's spending doesnt contain things about what he's "digging up", only the expenditures. If you're looking at The City of Naples stuff, its probably permits for activities. The arrogance of the CCSO nowadays is spellbounding. The way they treat the general public will LOSE this election for Rambosk.
