Lee deputies nab 25 illegal immigrants working on sheriff's building expansion

In cooperation with the Lee County Sheriff’s Office, special agents from Immigrations and Customs Enforcement on Thursday morning arrested 25 illegal aliens working on the “Core Expansion Project” on Ortiz Avenue in Fort Myers.

The arrests could prove costly for a Collier County construction company in charge of the project. Lee County officials said Kraft Construction is in violation of a $52 million contract for having undocumented workers on the job.

Sheriff Mike Scott called the entire affair “an embarrassment” to society as a whole.

“It’s ironic that of all the projects they could be working on, they were working on a jail facility,” Scott said. “In my opinion, it’s symptomatic of the bigger problem facing this country. Until we secure our border, we can’t even begin to dream of changing things. It’s like all the barn animals are out, and now we’re just starting to think about closing the door.”

The undocumented workers — 22 men and three women and hailing from Mexico, Brazil, Guatemala and Peru — are in custody at the ICE Office of Detention and Removal while awaiting the outcome of their removal proceedings, according to ICE spokeswoman Barbara Gonzalez.

Scott said about half of the 25 illegal workers were employed by a single subcontractor, but would not say which one.

“I hope this sends a message that it’s just not worth it,” Scott said. “Eventually, you’re going to get caught. You’re not going to get away with it. These subcontractors had people working for them that shouldn’t have been working for them, and they got caught.”

Scott said Kraft Construction — the main contractor on the job site — is “an extremely reputable company.”

“We have to find out how this was allowed to happen by licensed, reputable, insured companies,” Scott said, referring to “several” subcontractors who are working on the job site along with Kraft, but declining to name them.

Earlier reports out of the sheriff’s office show that Spectrum Painting in Collier County was one of the subcontractors involved.

According to Hoover’s online, Spectrum Contracting, a painting and paper hanging business, has 200 employees and reported sales of $7.3 million in 2006. The president is John Schallert.

“At this time, we are unable to confirm how many of our employees have been detained by INS this afternoon. Every person who applies for employment with our company goes through our hiring process, and that includes producing the required documentation to prove employment eligibility. Just as any other business does, we want to hire people who are hard working and take pride in doing a good job,” Schallert said.

Spectrum Contracting has been a specialty contractor in the area for 15 years, providing waterproofing, fireproofing, hurricane repairs, reconstruction management, specialty coatings and painting for commercial buildings and high-rises.

Kraft Construction got the $52 million contract to work at the jail in 2005. The county didn’t have a specific requirement that illegals not be hired until 2007, but Kraft signed an agreement then saying they would not do so and would see to it subcontractors didn’t either.

“Now we have an affidavit they have to sign before they can bid,” said Lee County contracts manager Cindy Logan. “Anyone who wants to be on the bidder list has to sign.”

Logan said the county notified those already working on county jobs of the requirement. Kraft signed in 2007 agreeing to the new rules.

“We do have a vendor application on file where they agree not to hire illegals.”

“When they started the jail contract there was no requirement,” Logan said. “In August last year we got the new application approved, and signed it then.”

That means Kraft is responsible to the county for not having illegals working on the job, Logan said.

The initial reaction from Lee County officials is that Kraft likely won’t be terminated for using illegal alien workers on a county project.

“Kraft needs to deal with the subs,” Commission Chairman Ray Judah said.

Kraft spokesman Richard Hart said there is no relationship between the two companies, and Spectrum bid the work to win the contract from Kraft.

Hart said that one of the employees picked up Thursday works for Kraft. He said the company requires proof of legal residency, and the worker in question provided documentation he was legal and passed a background check. He said he’s sure Kraft would reflect county requirements in its contracts with subs.

County Public Works Director Jim Lavender said his initial reaction is Kraft won’t be fired, though the company is in violation of its contract because of the illegals.

“We haven’t really had this before,” he said. “My attorney is not in the office today. I just don’t know right now.”

Lavender said the jail project is virtually finished, and the county expects to accept the project in July.

“It seems to me the response would be that they saw documentation and maybe they were fake documents,” he said. “I can’t begin to tell you what the outcome might be.”

Lavender said he’d personally like to see Kraft finish the jail project.

“Is it in Lee County’s best interest? I don’t know,” he said.

Judah said he didn’t want to address the larger immigration arguments. Recent changes in federal law have been designed to penalize those companies that hire and profit from illegal workers.

“I’m not getting into ideology,” he said. “The pros and cons of hiring employees that are legal or not legal, whether it’s an impact or benefit to the community. The fact is it’s stipulated in the contract they won’t be hired.”

You may be partially right about many "Anglos" who get picky or mouth off about the type of tasks they are required to do on a job. And the fact that many Anglos in the service field have a high turn over rate.

BUT....
Does that justify FEDERAL LAWS being broken ?
And a DOUBLE STANDARD for us LEGAL folks ?

If you answer YES, then I believe you would find living in a 3rd world Banana Republic more to this ideal!

It's not like they just drive them to the border and drop them off. Now we get to house and feed them. Their families will go hungry. Spectrum is history. With no income, he'll file for bankruptcy when heavy fines are levied and we will get to absorb his losses one way or another. Now the painting won't get done. The workers are scared so they won't come; the white guys won't do it.

The answer isn't deporting them. The answer is quit making it so blasted hard for them to "do it legally" as everyone is always screaming. Let them come in, give them green cards and work permits, then tax their income like the rest of us. I know a Mexican who applied for status 11 years ago. 11 years!!

That's the true crime here.

a friend of mine hired an illegal who was a really good learner and worker and told him if he wanted to work full time he had to become legal.

Jose went to miami and bought a dead guys SSN for $50, then returned to miami to and paid off a guy in the DMV and got a valid FL drivers license,, now he's legal and working full time?

after 3 years of working full time and paying income tax on a dead guys SSN (govt doesnt care its free money for them) some how he managed to get a T.I.N. # (taxpayer identification number) and filed a tax return for the last 3 years and got a refund check for $6,500.

I know I built quite a few myself even though i'm 'Anglo' as a new born babys behind. I dug the footings, placed the concrete, layed the block, framed the roofs, installed the doors, windows, and cabinetry, painted the surfaces, landscaped the yards and everything else that was needed all while the Castro's, Vincente Fox's, Hugo Chavez's, and their kind were robbing your people blind.

#17 - How is it that "Jose" and others that milk the system ( not just the illegals, some white folks too) can file taxes, whether it be legally or not, and get a refund check of $6,500? I just don't get it. The most my refund has ever been was right around $600. I know someone (female) who has 3 kids, works odd nursing jobs and gets $7,000-$8,000 back each year. It baffles me.

We will take the remaining 2 limbs as payment!!!

There is no "Spectrum Painting" or any variation thereof listed with the Dept. of State as a corp, llc, or even a fictitious name out of Collier. Wonder if they're even a licensed "business" or just a gypsy operation?

Seems to me that the Sheriff's office would have done it's due diligence prior to retaining this outfit.

I just went to www.sunbiz.org and found a Spectrum Contractin, Inc. registerd to a Robert D.Valentine and an officer named F. Fred Pezeshkan. Both of these gentleman are big wigs in Kraft Construction.

Kraft is the main contractor for the extention of the Collier County Courthouse building, Sheriff's Dept. buildings, etc. They have also been contracted to do the work at the Lee County Sheriff's Office.

So, Kraft Construction itself hires illegals do work for them....interesting.....very interesting.

NDN, you guys need to do some additional investigative work on this story!

Let's just see if Naples Daily News "Staff" will follow up later with the results of all of this... or if they just post these headline news articles and move on to the next. Just drama and text to fill the paper and website, but no actual JOURNALISM.

From my observation... these things just eventually roll off the site and we never hear anything more about it until the next incident happens like it again.. and the racists and illegal debaters start all over again.

It's my unstanding that Kraft Fines its' subs for violations on the work place now lets' see if they get fined.Before a sub can pick up their check they must in turn pay the fines charged by Kraft. Looks like the door has opened for others to fine Kraft/Spectrum!!

FORT MYERS: Deputies have detained 25 construction workers at the site of the new Lee County Jail off Ortiz Avenue due to concerns over their immigration status.

The sheriff's office says subcontractors were employing illegal immigrants.

Several illegal workers could be seen wearing handcuffs and being placed into patrol cars late Thursday morning.

At least two were wearing a shirt bearing the name "Spectrum."

Deputies have said one of the subcontractors was a painting company out of Collier County.

The 25 illegal immigrants were taken into the custody of Immigration and Customs Enforcement, which participated in the sweep with Lee County deputies.

Twenty three of those arrested were men, three were women. They were from Mexico, Brazil, Guatemala and Peru.

The suspects are in the custody of the ICE Office of Detention and Removal. They have all been placed in removal proceedings and will remain in custody pending the outcome of their case.

B) The story, originally published 11:12 a.m., Thursday, May 15, 2008, contained only two paragraphs and described Spectrum only as an outfit out of COLLIER county.

The sentence is worded that the individuals are from Collier, not the company. MANY Port Charlotte companies do business in Lee and Collier. Lee/Collier are not an island unto themselves.

Spectrum is a sister company, division of Kraft Construction. And they are doing very well for themselves. They moved into the multi million dollar building complex just West of the new Naples Nissan dealer on Pine Ridge Rd. near I 75 in early 2007.

Wonder if they prospered much off illegals. I've subcontracted for them and most of their paint crews are Hispanic, most of the crew bosses as well.

Welcome to the new world. There are many, many workers (legal) that will gladly do any type of work...for a fair and reasonable wage. Unfortunately, the powers that be, including politicians and employers like documented and undocumented labor that keeps costs down so they can put more money in their pockets and keep inflation lower. This is our world until we stand up for our rights as US citizens and demand fair wages for labor. Labor unions have abused the system in the latter part of the 20th century and the result is lower wages across the board for the middle class. When workers feel enough pain, they will stand up for fair wages, with or without organized labor, but as long as our government turns a blind eye to undocumented labor we will feel the pain. Wake up!

Sheriff Scott was not in charge of this construction project, it is the construction manager who is at fault.

Do you understand the fault in your assumption that Sheriff Scott is somehow in the wrong?

Kraft Construction has a signed contract and affidavit with the county, which clearly states they may not employee illegal workers. Further, it also includes the subs they select for the jail expansion project not using illegal workers.

The Sheriff and ICE did a great job and I compliment them on the professional manner in which they carried this operation out.

Now it is up to the county and Immigration to determine the appropriate punishment.

With all the power behind Kraft I doubt this is going to turn into much. They have completed many quality projects, and have a venerable repuation in the industry.

So, let me get this straight... Kraft has just signed a rule that they WILL NOT HIRE ILLEGALS. One of the companies they hire, is loaded with illegals....
Now, county officials 'hope Kraft can finish the job, they 'doubt' that Kraft will be penalized.....

The Governor, Lt. Governor, State Rep. Aubuchon, Congressman Mack and all the County Commissioners have been informed, and now it's up to them to all work on the best route forward that eliminates these type of errors from occurring in the future.

Hopefully, the NDN will continue to investigate, and whomever pointed out the multiple changes in the story line--you are not alone. Don't know if that means what some have said about the influence the Kraft Organization exert over the media, but all the versions have been saved for reference later.

I'd hope that OSHA and other investigators would have uncovered whether the Kraft Co. had illegals working on that site during their review of the site post the deaths.

"The county didn’t have a specific requirement that illegals not be hired until 2007" So that means in 2006 you could hire illegals and keep them because their grandfathered in?? Kraft is paying off so many officials its not funny they just call it campaign funds. So political stunts like this is where Mike Scott is devoting his resources! My house got broken into last week and it took four hours to get a deputy out there to write a report. And even then I could tell the guy couldn't give a darn about what happened to me. Hey sheriff - how about solving some crimes instead of attacking people who aren't hurting anyone. I wish you'd put one tenth of this manpower into figuring out who took my stuff. We're getting beaten up by burglaries in Lee County and you decide to pull a publicity stunt like this?

Regular Americans thats who.

It's called negotiating for a wage. When the subcontractor goes out and looks for workers, they yell out what they want to pay and the first fool to raise his/her hand is the one who gets the job. Illegals are living in dread of being caught so they do the least complaining and the prospective employer knows that. Hence the lower wages paid.

Lower wages are due in large part to the fact that the illegal doesn't want an audit trail from taxes being paid.

Once the illegals are history, the subcontractors will simply find that hands will not be raised at the first wage offer and will have to offer more for the services of regular Americans. It is not that regular Americans are afraid of hard work, they just know when a subcontractor is cheating its workers with sub standard wages.

This idea the regular Americans are afraid of hard work is simply an outright lie.

the key word is all are 'CREATED' equal. then it's up to the individual to exert free will.. whether it's sin, compromising the sovereignty of another nation, growing and selling dope, stealing a boat and smuggling humans, running a house of ill repute, etc etc etc
