Suspected illegal aliens face deportation hearings

Lee County officials trying to determine legal status of 25 employees working for subcontractor on new jail

Following Thursday’s arrest of 25 suspected illegal aliens who were working on the new Lee County jail, deportation hearings will determine how many of the workers will return to their home countries and how many will remain within the United States.

Barbara Gonzalez, a spokeswoman for the U.S. Immigration and Customs Enforcement agency, said the detainees — 22 men and three women from Mexico, Brazil, Guatemala and Peru — are being held in ICE custody in anticipation of the hearings. She said they are currently being held in a Pinellas County facility, though they will likely be moved in the near future.

Gonzalez would not discuss other facilities to which the detainees might be moved. She also refused to give the names of those arrested, citing privacy concerns.

An immigration judge will determine what happens to the detainees next, Gonzalez explained. "If they’re ordered deported then ICE will carry out those orders," she said.

Gerald Seipp, an immigration attorney in Safety Harbor who is not representing any of the detainees, said a judge will take more than immigration status into account before ruling.

"They’re individuals," he said of the detainees. "Each one may have their own profile."

The most important considerations, Seipp said, include whether a detainee has a criminal background, whether he has been deported previously and how long he has lived in the U.S. Illegal aliens who have previously been arrested, convicted or deported likely have little hope of remaining in the country, Seipp said. Those who return after being deported can actually be prosecuted federally, he added. In March, a 42-year-old Jamaican man with a criminal record was sentenced to five years by the federal court in Miami after entering South Florida following an earlier deportation.

Some of the 25 may be allowed to post bond, Seipp said, if they can show ties to the community that keep them from being a flight risk. Long-term ties and a clean slate could also convince a judge to cancel deportation and allow the individual to remain in the country, the attorney said.

Such a cancellation occurs when detainees "show they have sufficient ties to their area," Seipp said. "Let’s say it’s someone who’s been here a long time and has children in school. Maybe they own a home."

Seipp also said that the federal government could charge some of the detainees with document fraud, as some were reported to have false identification documents. By Florida law, employers are required to check the citizenship status of employees they hire. Gonzalez would not discuss how many of the detainees had false documents.

Lee County attorneys are waiting for confirmation from ICE that the 25 employees snagged off the jail job site were, in fact, illegal aliens.

Deputy County Attorney Andrew Fraser said that he has also requested copies of the documentation relied on in hiring the employees.

"We haven’t determined if they’re in violation," said Fraser.

If the jail project’s main builder — Kraft Construction — or the subcontractors knew they were hiring illegals, then county commissioners can find them in violation of their contract.

"The commission would have grounds to terminate," he said.

But should they? County Public Works Director Jim Lavender says the $52 million project is almost done, and he questions whether terminating the contract would be in taxpayers’ best interest.

Federal laws enforcing civil penalties against companies hiring illegals have been strengthened lately, and U.S. Rep Connie Mack, R-Fort Myers, supported it.

"Quite simply we’re a nation of laws and those laws need to be enforced," said Mack spokesman Jeff Cohen.

Immigration raids have made headlines in recent years as the national debate over immigration policy has raged. In fiscal year 2007, ICE removed more than a quarter of a million illegal aliens, a record, according to the agency. Recent nationwide raids include a meatpacking plant in Iowa on May 12, in which nearly 400 illegal aliens were arrested, and a raid on the construction site of a new U.S. federal courthouse in Richmond, Va., on May 8, in which ICE agents arrested 33 people.

Gonzalez and other officials with ICE declined to give statistics for arrests of illegal aliens in Florida. Another recent raid in the state includes a bust of a "sham marriage" ring in early May, in which 80 illegal aliens were arrested in several cities for forging marriage documents that would allow them to stay legally in the country. According to an ICE press release, several of the arrests were made in Fort Myers.

Again Kraft is not responsible, like they said some of them may have false documents how do you know? So if they are allowed to remain in the country can they have they're jobs back. A lot of painting needs done and Spectrum is now really short staffed.

So, one wonders how they got the job with Kraft because I am sure that Kraft uses e-verify to check the "suspected illegal alien's" SSN. My guess is they all used false documents to get the jobs. Try that is your a legal resident or citizen. ITS OUTRAGEOUS if the judge lets them stay here! And by the way, the house is considering gutting the e-verify program now..because it works much too well and their big business buddy's don't like it. Go to NumbersUSA and write and call Washington. Help save our standard of living because that is what they are destroying.

hey bramble like i have said before if a legal US resident is competing for jobs with illegal immigrants they have some serious problems. Had they applied for those jobs like the others there should not have been a competition as to who gets the job.

The illegal aliens are nothing more than common theives. They come here illegally and steal the jobs our younger citizens could be doing. Liar liberals will try to distract you by saying that our young folks don't want the jobs. They are still liars.

It is time for us to stand up and demand that employers stop cheating us and our children by insisting they refuse to hire any illegals. Without jobs the illegal aliens will soon be forced to go back to where they came from.

We must get up off the couch and away from our TV's and boycott any and all business who hire illegal aliens.

Illegal aliens do not belong here, they must go home to their native countries NOW!!!

ok people why doese it always have to be about a racial matter, like seminole 2 said if you have to compete then there is a problem. i mean come on the citizens here went to school here and all and still cant get a job and it cant be that the company is paying these illegals less cause i had a friend that was illegal and was earning at least 22.00 dollars an hour and a friend that was legal and earning 15.00 an hour but it was because one had more expirence then the other. and why not let them stay with out them none of these hard labor jobs would get done cause i know all these moma boys dont want to get there hands dirty

OK I have to say something here. I want to give some FACT about Kraft and Spectrum. How do I know them? I am married to a Forman at Spectrum.
1. These guys get taxes and Social Security taken from the taxes every week and every one of them has medical care thru the company. This is money most of them never see again. A lot of them would be due a return if they were able to file their taxes. Some who have Tax Id Numbers are able to file their taxes and some of them get back returns and some have to pay more in and they do pay more in. (I have proof of that)
2. Yes they did break the law how they got here and how they got their jobs, but most of them like any other group of people are not bad people. They do work hard and they do jobs that most people I know that are US Citizens would not do. They work on the sides of 10+ story buildings with chipping hammers and hazards chemicals.
3. Spectrum does hire “white” guys they pretty much hire anyone who is brave anof to do the job, but I don’t know any of them that out work the Mexican guys. I have been to the jobs and I have watched the work being done. I would see the “white” guys standing around taking on their cell phones and not anywhere near the building. Now this is not all of them but it is quite a few of them.
4. Only a few of them end up in Jail just like any other race of people there is good ones and there is bad ones. In the entire company of Spectrum who HAD 200 employees up until this week, I know of only 3 who had been in jail. The reason why they were in jail was driving violations. I do not know of any of them that has ever stolen anything or committed a felony.
5. A lot of them either know English are trying to learn English or want to learn English. Some will ask my husband or myself “what is this in English”
6. They get up every day before the sun, go to work, and go home in the afternoon. Like with any guys they go to friends homes and sit around laughing and talking. Some drink but most no. Just like any other group of men.
7. They would have come here legally if given the chance. Some do try but the process is almost impossible. These are poor people, In order to come here they need to have money in the bank. If they had money in the bank they would not need to come here to find a job.

There is so much more about these people that us as US citizens should thank about and know before judging them.

Wow - many of you have no idea what you're talking about here. The illegals ARE taking jobs away from legal Americans because they ARE working for less. The contractors that hire them DO NOT always pay taxes, they treat them as subcontractors and give them a 1099 at the end of the year which of course the Illegals do not then file taxes and pay their share. I agree that most Americans will not pick tomatoes, but that is not the job that we're talking about. I don't believe that Kraft was aware of the residence status of these people, but I do believe that the subcontractors that hired them were aware and the bids they submitted to Kraft reflected the savings. Legal American business can not compete. It cost more to run your business legally. Period.

Now a little bit about what has happened since Thursday that the news seams not to want to talk about.

Spectrum was a mad house Thursday and Friday. They quickly fired almost 100 employs; some of them even had legal papers. How did they know who to fire? Well a few months ago Spectrum ran all the SSN of every employee they had. The ones that came up bad were called into a meeting. Spectrum explained to them that the SSNs had a problem told them they had 90 days to fix them. When a SSN comes up with a problem the employer is required to give the employee 90 days to fix it. No matter if they think it is fake or real. The guys all signed papers agreeing to this. The ones that were not able to fix the problems were fired. They guys that are in the process of applying for Citizenship were aloud to stay until the owners discuss it with the Immigration attorney.
Most of the guys that were fired had been with the company for 5+ years. Some had been there as long as 10 years. A lot of them have wives and or children who are US citizens that depend on that income to eat and live. Now they don’t have it.
In my husband’s case, my husband is and has been in the process of applying for US Citizenship and has been approved to do so. I am a US citizen, I was born in the US and have lived in Florida most of my life. We have 4 children (2 of which are not his but since their father s are not in the picture he has raised them as his own) are all US Citizens. Now we don’t know if he will have a job next week, we have already been having problems paying the mortgage the last couple of months. This family only has one income because with 4 kids I myself was unable to work. It would be easy for me to go and get a job but it would not cover all the bills. I just would not make as much as he does. I would need to get my kids on food stamps and Medicaid.
Now we file our taxes every year and do get back a return because we have 4 kids. Just like anyone else that has 4 kids and 2 mortgages. But the thousands of dollars of Social security that he has paid in for the last 8 years of working at Spectrum he nor our children will never see it again.
If we lose our home we will have to move 500 miles away and live with my parents. Which is something I never would have ever done again. Don’t get me wrong I love my parents but my father was a alcoholic most of my life and after more than a few hours together we fight. Not something I want my kids to see.
About the other happenings since Thursday. I can tell you there would have been 26 but one guy saw them coming with the cuffs and hide in the bushes until 9:00pm. He for one is still free and at home.
This has been a chain reaction that has not stopped It has affected hundreds of people illegal and US Citizens. And not the rich I could care less how it affects them I am talking about the working class.

I don't know about every company in the world but I do know that Spectrum does take out taxes each week. I can prove that. Alot of them do file their taxes at the end of the year. Most of them go to the fleamarket and pay a lady there $25 to fill out the form every year with their leagal Tax Id number. They mail them off even if they need to pay. I have seen some of them save up for weeks to send the check in.
Some of them file at places like Jackson and H&R block in fact I have sent several to the guy who does my taxes each year. Because they have a TIN they are able to file taxes.

That is truth vanilla,I trained more that a dozen people in my job,US citizens, so far non of them kept their job,one used to come drunk,other drank at work and other used sleep at the job,others could not do the job right,out of that dozen just one was good,happens to be a hispnic from Texas,I don't know if he was illegal,but some time latter he was arrested for DUI,the company allow him to came back to work 'cause there were shortage of applicants,but then he was pulled over and was driving whit his DL suspended and that was it.
SOME People have that sense that if there are blacks or latinos at work,they feel that they should have special treatment and higher pay,if blacks and latinos are making 15 an hour I should make 17or I will quit,that is how SOME think.

The truth is alot of people have no idea what is going on. I had no clue about any of this until I married my husband. Now is like a whole other world of fear and shame. I can tell you that telling me was the hardest thing my husband had ever done. It was the first and only time I had ever seen him cry.
After we were married we filled for his citizenship which due to the way he got here will take several years to complete. He is alowed to be here now. But he is honestly not leagal or illegal he is sort of in the middle. The INS can not deport him and he has a legal drivers lic.
Some day he will be a full US Citizen and he looks forward to the day.
They only flag that hangs in my house is the US flag. He is proud of where he came from but he is also proud that he will be part of the US.

Spectrums start pay is $10.50 an hour no matter who you are. Unless you have worked for them before or have worked in the same field. You start out doing all the "grunt" work. You train you lean after about a year if you are still there they bring in you in for a review if you are doing your job right and working hard they up your pay $1.50-$2.00 more an hour. They bring you in every year and do the same thing. Now they do have medical and dental. Total for an employee is around $20.00 a week.
My husband start 8 there 8 years ago doing the "grunt" work. Then the starting pay was $8.50 an hour. Now he is a forman after 2 promotions. He makes $19.50 an hour (he is due for another review but all of this has set it back) he drives a company truck, has a company phone, he has a company gas card, a company credit card for Home Depot, he receives 1-2 PAID vactions a year (depending on if he asks for a second), the company paid for him to go back to school, he receives 2 bonuses a year one for Christmas and one for all the jobs he has done, and their is so much more the company does for him they help him any way they can.
Yes I think he should be paid a bit more for what he does mainly because I don't like they idea of what he does. He spend most of his day on the side of a building. Not something I would ever do.

It's supply and demand. If you allow 20 million illegal aliens to work int eh country, then that increases the supply of workers. That drives down incomes for legal workers. That is why businesses want illegals. They don't have to pay them as much, provide health care, pay unemployment worker's comp claims, and can abuse the workers in many other ways.

Bottom line: They are here illegally. They should be prosecuted with a felony, deported and not allowed to re-enter our country. If in this case, Kraft Construction knew or should have known that the workers were here illegally, then officers of the company should face prosecution too.

msboo96: Your wrong. Yes they do pay taxes. Almost all of my friends are hispanic, a majority of them "undocumented". They do recieve paychecks through payroll just like we do. The majority of the 12 million "undocumented" people here recieve pay their taxes. they pay their federal taxes, pay into social security, medicare, ect ect. They use their T.I.N. NUMBER(TAX IDENTIFICATION NUMBER) to file their taxes at the end of the year. And yes they do file. They know that once the United States decides to give them documentation they must prove they paid taxes while they were working here. The ones that are working "under the table for cash" are the MINORITY. Remember also that there are "undocumented" people from every single country in the world, not just hispanics. And No they do not work for low wages. In restaurants they work for no less than $8 to $12 an hour, which is the correct amount for that position. My friends that work in construction get around $15 an hour. I even have "undocumented" friends that make over $50,000 a year and own their own houses. They also pay property tax. No, they do not take jobs away from anyone. There are plenty of jobs out their for everyone in this country. If someone is not working, it is because they are lazy and do not want to work. Or they think they are worth more for the position. We should not be paid more money just because we are AMERICANS. It is what the job is worth. Everyone is equal. Restaurants are always hiring. McDonalds, Burger King always need help. $8 an hour is better than sitting at home and making $0!!

Ahh - hello? They are illegal! They have no privacy, they have no rights, they are owed absolutely nothing from us, including privacy.

They shouldn't be owning homes, they shouldn't have children enrolled in schools, and their " long term ties" (years and years of dodging the law and not getting caught) should not be REWARDED with bond. What is wrong with you people?

I watched a news story as some of them were being arrested and saw two of them throw gang signs at the camera.

Deport them all!

Kraft looks at the bottom line, i.e., profit. Kraft does what ever it takes, to make a profit. Profit rules. Profit is the global ecomony way, not The Made In The U.S.A. way.
There was a time in recent history when a building was "topped out" a Made In The U.S.A. flag was proudly erected on the high point of the structure in the hands of iron workers. The flag is no longer Made In The U.S.A. and Kraft will insure that foreign illegal labor will prevail to profit for the global economy.

Just deport them already. Get rid of all the illegals.

American's won't pick tomatoes and produce until we have to choose between doing it or going without. Give those jobs to teens as part time jobs. Keep them out of trouble and teach them the value of a hard day's work. OK now a lot of people say "Send them back". First off there is no way the government would ever send them back. Maybe a few here and there but not all of them.
What would happen if they did? Well for one it would cost millions of dollars to send them back. They would have to hire more people to find and try to find a way to find them. Load them up on buses, house them, feed them, and transport them. There would have to thousands of people working at the border to process them, judges, guards, and everything else. Why all that is happening who would be left to deal with the crimes like theft, murder, etc. And trust me there would be havoc. It would be a war.
Then they would have to find away to keep them out. What are they going to do build a wall and put guards and cameras every 2 feet? It’s that whole "If there is a will there is a way thing". No matter what is done they will come back.
Now their families that are left here. There would be broken homes, kids would lose parents, parents that are legal and US citizens would have to get Medicaid and food stamps because they would lose the income they need to live with.
Homes would be empty, there would not be anof people to buy them and rent them. An entire new work force would need to be trained and quickly.
Fields and stores would be empty, teachers would be without jobs. I know one school here where a lot of the parents are illegal but the kids are not.
Now thinking about our area. We all know when we go to the store here there is people that is illegal working there. Now sure put the teens doing their jobs, why not? Well what about during the day when the NEED to be in school and in the afternoon when they have home work. Are you going to go and do the jobs? And there is a lot less teens that are able to work in this area then there is illegals.
Would you want your kid out doing some of their jobs? Working on the roads, repairing the condos out on the beach, clean homes for the rich. And the fields well what are they going to do work them in shifts? Some be in school and some be in the field working. Drop us back in time why don't you.
Things are not as simple as send them back. There is a lot more to it than that. Taxes would go up social security would go down. It would take this country YEARS to recover.

But what if they are made legal? Well first they would have to pay fines and the ones that didn't pay taxes would have to pay back taxes. They would go to driver’s license office and get the license (about $25.00 each) those offices would need to hire more people just to handle all of them. More would buy homes upping the housing market quick. More kids would go to school, which does mean more schools but the fines alone they pay would cover that. No more free rides at hospitals and such they would have to pay for their treatment. Ok and Medicaid sure some would sign up but just like everyone else most would buy their own or receive thru the companies they work for. All of this would create more office jobs, pay would go up because of it. The army would grow, less kids going off to fight. The more that become legal the more money that would be there to be made. They could do more and buy more. There would be more tax dollars coming in without raising them. They would need to learn English, so more teachers needed there. They would pay for it so more money for the school systems. Sure money would go out but more would come in. There would be more jobs. Just do the math and try to add it all up we are talking either spend billions and lose it or spend it and make 3 or 4 times that back. It’s like a game make the wrong move and loses the game, make the right move and win.
There was a report out in 2007 that said it would cost around $8000 or more per person to send them home. But it did not include what it would take to find them. So there are around 20 million illegals in the US so that is $160,000,000,000 just to transport them, feed them and house them. They said that was the low figure that it could be higher. Now where in the world would all that money come from? Taxes, they would go up again. Now they said they would charge each one about $10,000 in fines and they would have to pay back taxes. Just from there fines there would be an addition $2,000,000,000,000 for the country. WOW now what could we do what that. Not to mention all the other money they would bring in. DO THE MATH!!

Hey all you Pro-ILLEGALS out there!!!

I walk into a bank that I do not have an account with and hand a note to the teller that says, "Put all the money in this bag". She/he complies with my demand and I walk out of the bank with thousands of dollars. I get in my car and drive away but, 2-miles down the road several police cars stop me and scores of officers get out with guns drawn.

They search my person and my car finding the thousands of dollars in loot in the big bag the nice bank teller handed me with a smile. They handcuff me,rough me up a little, haul me away to jail, put me in one of those nice orange designer jumpsuits, take a glamour shots photo of me, and post my picture & criminal bio on CCSO's arrest log/ Latin criminal dating website.

I go up infront of the judge the next morning and he asks why I robbed the bank and tells me the consequences that I'm facing. I tell him that I did not rob the bank, I made an UNDOCUMENTED WITHDRAWAL!!!

The judge tells me that he is sorry for the inconvenience, drops all charges, hands me the bag of loot, and tells me to have a nice day!!!

The moral of this story is:

ILLEGAL IS ILLEGAL!!! UNDOCUMENTED IMMIGRANTS ARE ILLEGAL IMMIGRANT ALIENS AND NO MATTER WHAT THE MONIKER USED, THEY ARE HERE ILLEGALLY, AND MUST BE DEPORTED BACK TO THEIR COUNTRY OF ORIGIN AS DEFINED PER U.S. LAW!!!

This debate is really not so much about being anti-immigrate as it is being about breaking the law. Some of you say that they are hard working people with families who just happened to cross the border illegally. In your believe this gives them a pass. Give them citizanship, you say. With a decent government, there would be valid and sustainable jobs in Mexico. It seems that the biggest problem that illegal aliens have with our immigration law is that it takes years to get a visa....so what do you want us to do? Give YOU or YOUR FAMILY MEMBER a fast track? I feel that way every time I go to the emergency room because of all the illegals there but when I complain about it they say "WAIT LIKE EVERYONE ELSE" So get in line with the other 100 million people from all over the world who want to come here and realize that you are no more important than anyone else.

I truly hope one of these laws do not include Leviticus 25:44 which God clearly states that "Your male and female slaves are to come from the nations around you; from them you may buy slaves. You may also buy some of the temporary residents living among you and members of their clans born in your country, and they will become your property. You can will them to your children as inherited property and can make them slaves for life, but you must not rule over your fellow Israelites ruthlessly." These "illegals" would indeed be in deep doo doo if we still obeyed GOD's LAW.

20 years ago I worked in this area as an electrician, aluminum framer, various menial labor jobs which barely paid a living with minimal benefits. I am white, wasn't the only one and the predominant minorities were blacks and cubans/puerto ricans. Spanish was rarely heard aloud. This was before NAFTA. I knew MANY white lawn maintenance employees, they often had insurance and 401K benefits as country club employees to boot.
Today I simply could not afford to work those jobs, they are 10-99'd to immigrants who have no intention of paying taxes. The illegals who are working as employees simply declare 5+ child dependents and aren't paying any income taxes, just social security. The argument that Americans won't do these jobs is false, Americans generally wont live in a trailer with 30-40 other people and require a living wage to survive at what we consider a civilized, if impoverished, level.
Spectrum painting is basically a division of Kraft construction, at one point their shop was in the back of Kraft's offices. It is very unlikely that Kraft was unaware of the status of these employees.
I have worked as a subcontractor in the time since, some of the largest contractors in this area not only know their subs are illegal, they even instruct them how to apply for worker comp waivers and 10-99 their existing employees if they haven't done so already.
As long as people chase lowball prices regardless of the source and ignore the long-term effects of their greed the situation in this country will deteriorate. Nothing is more ironic than someone complaining about spanish being spoken in a box store where everything is made in China or India, and expecting the same corporation that shopped its vendors to overseas child labor sweatshops for the lowest price to actually care.

the people of florida are partially to blame for this problem, Bill Nelson has never NEVER voted for immigration reform only amnesty. Mr Martinez voted for the kennedy-mccain amnesty bill then after he seen the voters getting mad he voted no on the remaining amnesty bills. and imo if he is elected again he will vote for amnesty. He's worried about getting reelected.
we also need to rid ourselves of the incumbents in the fl legislature and senate they all dropped the ball on the 9 reform bills that was brought to them
none would cosponsor any of them.
